1. Acceptance of Terms

You agree to defend, indemnify, and hold harmless Allure Laser Medispa, its affiliates, licensors, service providers, and its respective officers, directors, employees, contractors, agents, and clinicians from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms & Conditions or your unauthorized use of the Site.
8. Governing Law, Venue, & Mandatory Arbitration
These Terms & Conditions and any disputes arising out of or related to your use of the Site shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any choice or conflict of law provision.
- Mandatory Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms & Conditions, or the breach thereof, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.
- Venue: The place of arbitration shall be Leon County, Florida and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. You waive any objection to the laying of venue in such courts and any claim that such venue is an inconvenient forum.
9. Force Majeure
Allure Laser Medispa shall not be held liable or responsible to you, nor be deemed to have defaulted under or breached these Terms, for any failure or delay in fulfilling or performing any obligations when and to the extent such failure or delay is caused by or results from acts beyond our reasonable control (a “Force Majeure Event”). Force Majeure Events include, but are not limited to: acts of God, hurricanes, floods, fires, earthquakes, pandemics, epidemics, government orders, strikes, labor shortages, telecommunication failures, or internet service provider outages.
10. Severability & Entire Agreement
If any provision of these Terms & Conditions is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions of the Terms & Conditions will continue in full force and effect. These Terms constitute the sole and entire agreement between you and Allure Laser Medispa regarding the public website and supersede all prior understandings.
